Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and KR Fit + Fuel ("we," "us," or "our"), concerning your access to and use of the kr.fitness website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

By accessing the Site, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and you must discontinue use immediately.

Services Overview

KR Fit + Fuel provides the following services:

• Online personal training programs
• Custom nutrition coaching and meal planning
• Hybrid training (combination of fitness and nutrition)
• Educational resources including workout videos and recipes
• Access to client portal for program delivery

Client Responsibilities

Medical Clearance

You acknowledge that physical exercise and dietary changes can be strenuous and subject to risk of serious injury. You affirm that you are in good physical condition and do not suffer from any disability that would prevent or limit your participation in exercise or dietary programs. You agree to consult with a physician before beginning any fitness or nutrition program.

Accurate Information

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. This includes information about your health history, injuries, medications, and fitness goals.

Following Guidelines

You agree to follow all instructions and guidelines provided by KR Fit + Fuel. You understand that results may vary and are dependent on your individual effort, commitment, and adherence to the program.

Payment Terms

Pricing and Billing

Current pricing is displayed on our Services page. Payment is required in advance for all programs. We accept payment via credit card through our secure payment processor, Stripe.

• Monthly Programs: Billed monthly in advance
• Multi-Month Packages: Full payment due at time of purchase
• Payment Failures: Access to services may be suspended if payment fails

Refund Policy

Due to the digital nature of our services and the personalized programming provided, all sales are final. Refunds are only provided at our sole discretion in exceptional circumstances. Monthly subscriptions can be canceled at any time, but you will retain access through the end of your current billing period with no refund for partial months.

Program Cancellation

You may cancel your program at any time by contacting us at kelsey@kr.fitness. The following terms apply:

• Monthly Programs: Cancel anytime; access continues through end of current billing period
• Multi-Month Packages: No refunds for unused portions; access continues through purchased period
• Notice Period: 48 hours notice preferred but not required

Intellectual Property Rights

All content on this Site, including but not limited to text, graphics, logos, images, workout programs, meal plans, recipes, and videos, is the property of KR Fit + Fuel and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or in any way exploit any of the content without our express written permission.

Limited License

As a paying client, you are granted a limited, non-exclusive, non-transferable license to access and use the materials provided to you for personal use only. You may not share, sell, or distribute any content or materials provided as part of your program.

Disclaimer of Warranties

IMPORTANT: KR Fit + Fuel provides fitness and nutrition education and coaching services. We are not medical doctors and do not provide medical advice, diagnosis, or treatment.

• Results are not guaranteed and may vary significantly from person to person
• Testimonials and transformations shown represent exceptional results and may not reflect typical outcomes
• Before and after photos are real client results but individual results will vary
• You should consult with your physician before starting any fitness or nutrition program
• If you experience pain, dizziness, or discomfort during exercise, stop immediately and consult a medical professional

Limitation of Liability

To the fullest extent permitted by law, KR Fit + Fuel, its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the services
• Any injury, illness, or adverse health effects resulting from participation in our programs
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any content obtained from the services

Indemnification

You agree to defend, indemnify, and hold harmless KR Fit + Fuel and its employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from: (i) your use of the services; (ii) your violation of these Terms; (iii) your violation of any third party right, including any intellectual property right; or (iv) any injury, illness, or damage caused by your participation in fitness or nutrition activities.

Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information, including health and fitness data.

User Conduct

You agree not to:

• Share your account credentials with others
• Copy, reproduce, or distribute any content from the client portal
• Use the services for any illegal or unauthorized purpose
• Harass, abuse, or harm KR Fit + Fuel or other clients
• Attempt to gain unauthorized access to any portion of the services
• Upload or transmit viruses or any other malicious code

Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Modifications to Services and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. We also reserve the right to update these Terms of Service at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the services after any such changes constitutes your acceptance of the new Terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the services shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
